Under Michigan state law, a felony is any criminal offense which carries a potential term of incarceration of greater than 1 year (other than “High-crime misdemeanors”). Felonies in Michigan are classified by the seriousness of the offense according to the following crime class categories:
Class A Felonies: Felonies punishable by imprisonment for life or ‘any term of years.’ Examples of Class A felonies include Second Degree Murder, Assault With Intent to Commit Armed Robbery, Assault With Intent to Murder, First Degree Criminal Sexual Conduct and Kidnapping.
Class B Felonies: Felonies punishable by imprisonment for up to 20 years. Examples of Class B felonies include Arson of a Dwelling House, First Degree Child Abuse, Embezzlement over $100,000, First Degree Home Invasion, and Possession of 50 but Less than 1,000 grams of Schedule 1 or 2 Controlled Substances.
Class C Felonies: Felonies punishable by imprisonment for up to 15 years. Examples of Class C felonies include Delivery or Manufacture of 45 Kilos or More of Marijuana, Second Degree Criminal Sexual Conduct, First Degree Fleeing & Eluding, Second Degree Home Invasion, Operating a Vehicle While Intoxicated or Impaired Causing Death, Unarmed Robbery and Using Internet/Computer to Commit Crime At Least 10 Years but less than 15.
Class D Felonies: Felonies punishable by imprisonment for up to 10 years. Examples of Class D felonies include Assault With Intent to Commit a Felony, Delivery/Manufacture Prescription/Counterfeit Prescription, Larceny From the Person and Possession of Methamphetamine.
Class E Felonies: Felonies punishable by imprisonment for up to 5 years. Examples of Class E felonies include Possession of a Short Barreled Shotgun or Rifle, First Degree Retail Fraud, Receiving or Concealing Stolen Property $1,000 to $20,000, Carrying a Concealed Weapon and Operating While Intoxicated 3rd Offense.
Class F Felonies: Felonies punishable by imprisonment for up to 4 years. Examples of Class F felonies include Felonious Assault, Second Degree Child Abuse, Delivery/Manufacture of Schedule 4 Controlled Substance and False Report of a Felony.
Class G Felonies: Felonies punishable by imprisonment for up to 2 years. Examples of Class G felonies include Failure to Register as Sex Offender (First Offense), Larceny in a Building, Domestic Assault (with Prior Convictions) and Larceny from a Motor Vehicle.
Class H Felonies: Felonies punishable by jail or other ‘intermediate sanctions.” Examples of Class H felonies include Eavesdropping and Financial Transaction Device – Stealing, Retaining or Using Without Consent.
