Divorce Vs Legal Separation From A Divorce Attorney In Gaylord MI

Sep 27, 2013 | General News

While most people are all too familiar with the term divorce, a legal separation is another less common but sometimes financially beneficial option.  Not long ago the term legal separation was almost unheard of, however, today it is becoming more common as couples look for ways to save money despite their inability to remain together.  Whether you have religious or monetary reasons for your choices, choosing either of these options will require some assistance from a divorce attorney. What are your options and what does each mean to your financial well being and property? A divorce attorney can help you understand what each option will mean to you and your family.

What are your options?

You have three options, albeit only two which involve the law. You and your spouse can choose to separate on your own, choose a legal separation, or to divorce completely. If you choose to separate, it is important that you still consult an attorney as there are many arrangements which need to be made including in regards to the children, your home, property and bills.

Legal Separation

If you and your spouse choose to separate but not divorce, it is important that you realize that while you have not completely eliminated your marriage, you are making a major change in your marriage. To get a legal separation in Michigan you will need to file a separate maintenance action.

Note that in Michigan, the term legal separation does not really exist, however Michigan does offer married couples the opportunity to file a Separate Maintenance Action. A Separate Maintenance Action is a form of legal separation. While legal separation does not end your marriage, it still takes time, often as long as a divorce.  Consider your options based on what is right for you personally, not to save time.

Divorce

A divorce is the legal dissolution of your marriage and your assets and requires that you file a Complaint for Divorce.  A divorce is not final until the Judgment of Divorce is entered. In reality, divorce and legal separation are almost identical except a divorce completely dissolves the marriage as well as dividing all property, debts and assets.

If you and your spouse decide that you cannot work it out and would like to divorce or separate, it is imperative for you and your family that you get a divorce attorney to help you. Divorce laws as well as legal separation or separate maintenance actions have many different rules and laws associated with them depending on where you live.  If you are contemplating divorce or legal separation, let Harris Law help you.
