Frequently Asked Questions About Car Accident Attorneys'

How Do Car Accident Attorneys’ Work?

At Harris Law, our car accident attorneys handle every step of your case so you can focus on healing. We have a skilled team that immediately go to work on your case including  accident investigation, gather and securing evidence, obtaining medical records and expert reports, tracking down all insurance company information, and guiding throughout the entire legal process including a trial. The initial investigation of the case can be critical to the compensation you deserve.

Who Pays For a Car Accident Settlement?

Typically, the at-fault driver’s insurance company pays for the settlement. However, depending on the circumstances, other parties (such as vehicle manufacturers or additional insurers) could also be responsible. Also, underinsured/uninsured motorist coverage may be applicable depending on the insurance coverage available and the client’s automobile insurance policy. We work to identify all sources of compensation.

How Long After a Car Accident Can You Sue Someone?

In Michigan, you generally have three years from the date of the accident to file a lawsuit for personal injury. It’s important to act quickly so evidence can be preserved, and your rights are protected. Insurance companies immediately get their team involved in serious accidents and so should anyone who is injured by the fault of others.

Three Year Deadline: This applies to lawsuits against the at-fault driver for damages like pain and suffering, vehicle damage, and wrongful death in Michigan.

One-year deadline: This applies to first-party no-fault insurance claims, where you’re seeking benefits from your own insurance company for things like medical bills, lost wages, and other expenses.

Exceptions: There are exceptions to these deadlines, such as for minors or individuals who are mentally impaired. For example, if the injured person is a child, the statute of limitations may not begin to run until the child turns 18.

How Do I Get a Maximum Settlement From a Car Accident?

The best way is to have an experienced attorney on your side who understands the unique dynamics of your case. Injuries affect everyone differently and how it changes their lives. At Harris Law, we build a strong case with thorough documentation of your injuries, lost wages, and other damages, and form a personal relationship with our clients that remain once the matter is concluded. It is our belief that the attorney/client relationship is crucial for the person representing the client to fully appreciate the depth of the suffering that has occurred. Being here in northern Michigan allows us to have the personal interactions necessary to best represent our clients.

How Long Do Car Accident Settlements Take?

Every case is different. Some may settle in a few months, while others — especially those involving serious injuries — can take a year or longer. We aim to resolve your case as efficiently as possible while fighting for the best result.  We also want to be sure that the medical treatment is known and the prognosis for future care is clear before resolving matters for clients.
