HARRIS LAW DISCUSSES MARIJUANA POSSESSION IN CRAWFORD COUNTY MI

Possession of marijuana in Crawford County Mi is a misdemeanor and comes with a fine and may also include jail time, depending on the circumstances.

Drug laws are changing throughout the country due to the acceptance of the legality of medical marijuana and vary greatly from state to state. Like many crimes, the judge in the case does have some discretion in the sentencing in regards to both being accused of smoking or possession of marijuana. Being convicted of a drug charge, despite the fact that it may only be a misdemeanor (first offenders), can pose significant impacts on your life and the lives of those around you. Even a misdemeanor conviction of marijuana possession may exclude you from getting certain jobs, housing or even loans.

Rules and regulations in regard to the Michigan Medical Marijuana Act or the MMMA which was initiated in 2008 are in no way related to possession of marijuana not for medical purposes. For rules and regulations in regard to the Michigan Medical Marijuana Act, you can go to chapter III sections 333.26421 through 333.26430.

While possession of medical marijuana may be legal for those who are licensed, for everyone else, possessing marijuana is a crime. According the the Public Health Code Act 368 of 1978 in Michigan the following rules apply to marijuana and other controlled substances including narcotics (taken from www.legislature.mi.gov ):

333.7403 Knowingly or intentionally possessing controlled substance, controlled substance analogue, or prescription form; violations; penalties; discharge from lifetime probation.

According to this code, a “person shall not knowingly or intentionally possess a controlled substance, a controlled substance analogue, or a prescription form unless the controlled substance, controlled substance analogue, or prescription form was obtained directly from, or pursuant to, a valid prescription or order of a practitioner while acting in the course of the practitioner’s professional practice, or except as otherwise authorized by this article.”
In regards to possession of marijuana , a person who violates this rule is guilty of a misdemeanor punishable by imprisonment for not more than 1 year or a fine of not more than $2,000.00, or both.
